AMENDMENTS TO THE CIVIL PROCEDURE RULES COMING INTO FORCE IN OCTOBER 2013

This post looks at the changes to the Civil Procedure Rules introduced by The Civil Procedure Rules (Amendment No 7) Rules 2013.

 

These rules come into force on 1st October 2013.

 

The main provisions are that:

 

  • A Reply to Defence must be filed with a directions questionnaire.
  • A clarification of the costs to be paid on a provisional assessment. It is made clear that the £1,500 “together with any VAT thereon and any court fees paid by the party”.  This clarifies the rule deals with the argument that the £1,500 was meant to be “all inclusive”.
  • There are amendments to deal with the introduction of the specialist list in the Chancery Division the “Intellectual Property Enterprise Court”.
  • There are new procedures for reference to the European Court.
