CORRECT COURT FEE FOR COSTS ONLY PROCEEDINGS: IT IS £50.00

I am grateful to Beth King from Marsons who has sent me a copy of an e-mail from Beth King of Marsons solicitors.  There was a dispute with a county court about the appropriate fee for costs only proceedings.  Beth received an e-mail from the Fees Policy, Law and Access to Justice Group, confirming that her view that £50.00 was correct.

THE E-MAIL

“Having sought legal advice from MoJ lawyers regarding this query, I can confirm that you are right in that the fee for costs-only proceedings is £50. Costs-only proceedings are carved out as an exception to fees 1.1 and 1.5.

 The Civil Proceedings Fees Order 2008, states that “Fees 1.1 and 1.5 are not payable where fee 1.8(b), fee 1.9(a), fee 3 or fee 10.1 applies.

 I have notified colleagues at Dartford Court Court who would process your application, we would also amend letters sent out to court staff to reflect this exception.
