Often (once a month or so but sometimes more frequently) this blog considers a case where the judge has been critical of the witness evidence in written form. Often because the evidence is irrelevant, argumentative and consists of submissions. This is not necessarily a new phenomenon.

I wonder if you saw this case in the papers where we acted for the successful landlord against the tenant “liars”?

To quote from the above article:
“Retired solicitor Mr Clarke, who claimed to have a protected tenancy, had “deliberately chosen not to come to court and give evidence so as to avoid having to tell the truth”, said the judge.”

Gordon You may well be interested in the attached judgment I handed down this morning concerning the vexed topic of deduction of success fees from children’s damages.
