COURT OF APPEAL HEARING ON SANCTIONS TODAY: BREAKING NEWS AND LINK TO JUDGMENT

The Court of Appeal have allowed all three appeals in the sanctions cases that were before them. This is breaking news (as I write the judgment is still being given).

 

  • In Decadent Vapours the action had been struck out because a fee arrived at court. The decision of the Circuit Judge not to grant sanctions has been overturned by the Court of Appeal.
  • In Denton -v- White the appeal was against a decision to allow six new witnesses and vacate the trial date.
  • In Utilise -v- Davis the judge at first instance found that a number of trivial breaches were significant in refusing relief from sanctions.
