This is a disgraceful and inhuman judgment. All solicitors make mistakes, and all solicitors will, at least initially, try to cover it up. It’s human nature, and 99% of the time it works and nobody is any the worse for it.
This is particularly the case in these horrible firms mentioned in the judgment, where employed solicitors, particularly young and inexperienced ones, are working in a reign of terror, where mistakes are no doubt harshly punished.
The one thing that this cold and merciless judgment will ensure is that any solicitor who has made a mistake and covered it up is now going to do everything possible to keep it covered up, knowing what the consequences will be if they confess or get found out. Consequently, a bad situation may well become a disastrous one.
