LEXLAW -v- ZUBERI: PERMISSION TO APPEAL GRANTED
I wrote in July about the decision in Lexlaw Ltd v Zuberi  EWHC 1855 (Ch) (10 July 2020) in relation to the validity of a damages based agreement. Practitioners may like to know that permission to appeal has been granted by the Court of Appeal.
PERMISSION TO APPEAL
Lloyd LJ stated
“Although the purposive interpretation arrived at by the judge seems more likely than not to prevail in the end, the appellant’s construction is arguable, and the issue is of sufficient general importance to merit consideration by the full court.”
I have no information about the possible date of the appeal.
