Today I am encouraging you to read one of the most authoritative  and witty articles I have read about being involved in the civil litigation process.  How to Lose a Case is a post by Edmund King QC on the Essex Court Chambers website.  I would regard it is as essential reading for every litigator.

Since I am encouraging you to read the original post in full I am only going to give a small taster of the contents.  There are 14 individual points which provide invaluable assistance  you if you really want to lose a case (and may,perhaps,  be of some help f you don’t want to lose).

IGNORE THE FACTS

Edmund gives importance guidance to everyone who wants to lose a civil case.   Just one select point

“Every single case is only ever won on the facts, even the ones that supposedly aren’t. If the facts were worse, the judges would bend the law to do justice and sleep at night.”

“That’s why, ultimately all trials are won on the facts. Each side has to be able to give the judge a credible legal argument – but they nearly always can. Then the judge has to want to see the case through a factual lens that fits that legal argument.”
