DISCLOSURE AND DOCUMENTARY EVIDENCE: WEBINAR 19th NOVEMBER 2021

There are many cases on disclosure on this blog. Almost invariably these involve something going wrong. For example in Haider v DSM Demolition Ltd [2019] EWHC 2712 (QB) the court, on appeal, found that a claimant had been fundamentally honest when full disclosure had not been given.   On the 19th November 2021 I am giving a webinar which looks at the basic principles relating to disclosure, with the aim of avoiding the pitfalls.  Booking details are available here

MATTERS BEING COVERED

  • The claimant’s duty of disclosure
  • What are “documents”?
  • The difference between a reasonable request and a “fishing expedition”
  • The defendant’s duty of disclosure
  • What documents the claimant can seek from a defendant
  • Using documents to establish liability
  • The importance of “missing” documents
