INSURER GOING BEHIND CLAIMANT'S SOLICITORS BACK TO SETTLE CLAIMS: APPEAL PENDING; INFORMATION NEEDED

Attached to this post is the judgment in Gavin Edmondson Solicitors Ltd -v- Haven Insurance [2014] EWHC 3062 QB . That judgment is being appealed, permission to appeal having been granted. Gavin Edmondson are asking for more information in relation to the practices of the insurance industry in going behind the backs of the claimant’s solicitors and dealing with claimants direct.

THE PRACTICE

The practice is clear from the judgment. Having received information on the portal the insurer contacts the clients directly offering to settle for “a bit more” because they won’t have to pay legal fees.
