WHICH TRACK IS BEST? THE RULES, CASES AND GUIDANCE: ALLOCATION – SMALL CLAIMS OR FAST TRACK IN HOUSING DISREPAIR CASES: WEBINAR 10th SEPTEMBER 2025

Over the past month or so we have looked at three cases where the question of allocation of housing disrepair cases has been considered. The issue lies between Fast Track and the Small Claims Track.  This webinar looks at the rules, cases and guidance in relation to allocation in these circumstances. There is a particular emphasis on the need to plead the case as to damages – properly.

THE WEBINAR

This webinar looks at the rules, guidance and case law in relation to allocation between the Small Claims Track and Fast Track in housing cases.  It looks in detail at the rules and recent cases. In particular:

• The importance of pleading a case properly.
• Pleading damages.
• The significant case law as to damages in disrepair cases.
• The significant rules, and why they are often overlooked.
• What do the judges say? Learning from recent cases on allocation.

The aim is to make sure that participants are fully aware of the guidance and rules in relation to allocation and know how these are being applied when matters get to court.
