SERVICE OF PROCEEDINGS: ADDING TO THE "ESSENTIAL CHECKLIST"

One advantage of twitter is that it is instantaneous.  Tweeters today commented on the new practice at Salford of only sending one copy of the sealed claim form back for solicitor service.  This is something that can usefully be added to the “essential checklist” on service of the claim form.

THE DANGER OF SERVING AN UNSEALED CLAIM FORM

One commentator noted, immediately, that there was a real danger that an unsealed claim form could accidentally be served by the claimant.  Service of the unsealed claim form is not good service, Hills Construction -v- Struth [2013] EWHC 1693 TCC

SO CHECK YOU ARE SENDING THE SEALED CLAIM FORM

Applications in relation to service of the claim form are always stressful (for the claimant).  A check that it is the sealed copy that is being served is a useful (if not essential) form of self-protection.
