DENTON DECISIONS – AN INVALUABLE RESOURCE: RELIEF FROM SANCTIONS – A THEMATIC GUIDE UPDATED

I have written before about the invaluable resource provided by The Denton Resource. This has now been updated and is available  following the link here.  Congratulations to barrister Rachel Segal who took on this painstaking task.   The Resource is a pdf and can easily be downloaded.

THE RESOURCE

The Resource has been updated to the 11th September 2018.

WHAT IT DOES

It looks at the decision  on Denton -v- White in a thematic way, starting with decisions on pre-action conduct  and then dealing with 12 main areas including costs budgets, pleadings, disclosure, witness statements, expert evidence, trial, appeals and costs.

A USEFUL STARTING PLACE

This is always a useful starting place for looking at cases on relief from sanctions.  It is prudent to remember that these are not “precedents” as such.  Each case rests on its own facts. The Guide is excellent at showing the approach that the courts have taken to breaches in very distinct circumstances.

ANYWHERE ELSE TO LOOK

The “Sanctions: Case Watch” section of this blog attempts to deal with every decision that relates to Denton with links (where possible) to the cases themselves and related commentary. However this ordered chronologically and not thematically, which is where the Resource is particularly useful.
