GUIDANCE IN DEVON AND CORNWALL: VACATION OF COURT HEARINGS AND RE-LISTING

The President of Plymouth Law Society has sent out the following guidance.

COVID-19 – URGENT – CIVIL COURT HEARINGS TO BE VACATED – HHJ GORE QC

Dear Member

If you are a Civil Court user please read the notice below from HHJ Allan Gore QC following the guidance from the Lord Chief Justice.  It is important you pass this on to other colleagues.

All non-urgent civil applications/hearings/trial listed between now and 4pm 10th April are now vacated to be relisted after 12 April as a remote hearing by way of the attached template provided by HHJ Gore.  The template order drafted by HHJ Gore is designed to cover the following:

“Trials, CCMCs, routine civil apps, all money apps (like Orders to obtain information, attachment of earnings, oral examination of debtors and third-party debt orders) and even things like applications to discharge bankruptcy orders, attended oral stage 3 assessment of damages, infant and protected party approvals.

Any party disagreeing has liberty to apply in which case simply list it on notice to the other party/parties for remote hearing by telephone conference call to be booked by claimant/applicant if represented, if not by defendant/respondent if represented and if all unrepresented the court will have to do so.”

Please note the template order needs to be downloaded and then opened in Word.  It may not open on an phone/tablet unless you have Word reader.

This covers the civil courts in Devon and Cornwall.

Family cases will be governed by the template order of HHJ Robertshaw as in yesterday’s newsletter.
