CHANGES TO THE FIXED COSTS RULES 2: 20 PAGES IN AN EXPERT’S REPORT DOES NOT MEAN 20 PAGES

Another change being introduced on the 6th April 2024 is a change (or possibly clarification) in relation to to the number of pages in an expert report in the Intermediate Track.  The substantive report is still limited to 20 pages. The new rules clarify what is not included in that 20 page limit.

These are introduced by The Civil Procedure (Amendment) Rules 2024. 

 

 

THE CURRENT RULE

(c)any expert report shall not exceed 20 pages, excluding any necessary photographs, plans and academic or technical articles attached to the report.

THE NEW RULE

(3) For rule 28.14(3)(c) substitute—

(c)any expert report shall not exceed 20 pages—

(i)including the expert’s description of the issues on which they are instructed to give their opinion, the conclusions they have reached and the reasons for those conclusions; but

(ii)excluding the expert’s curriculum vitae, any supporting materials to which the reasons for their conclusions refer and any necessary photographs, plans and academic articles attached to the report..
