PERSONAL INJURY POINTS 10: WAS THIS CLAIM STATUTE BARRED?IF SO SHOULD THE COURT EXERCISE ITS DISCRETION UNDER SECTION 33 OF THE LIMITATION ACT 1980?

Here we look at a decision in relation to limitation. The trial judge had to determine whether the claimant's action was statute barred. If it was she then had to consider whether it was appropriate to exercise the court's discretion under Section 33 of the Limitation Act 1980.
