USEFUL CHECKLISTS TO HELP ENSURE COMPLIANCE WITH MAZUR: PART OF THE MATERIALS PROVIDED WITH THE WEBINAR ON THE 9th APRIL
The webinar on Thursday provides a wealth of material in relation to compliance with the Court of Appeal guidance as to the conduct of litigation after the Court of Appeal decision in Mazur. In addition there is a series of checklists to help everyone involved, from the firm itself to the person who has the work delegated to them.
“The delegation of tasks by the authorised individual to the unauthorised person requires proper direction, management supervision and control, the details of which are a matter for the regulators. The authorised individual must put in place appropriate arrangements. The degree of appropriate control and supervision will always depend on the circumstances.” (Sir Colin Birss in the Mazur judgment).
THE WEBINAR
Details of the webinar and how to book on are available here.
THE CHECKLISTS THAT WILL BE SUPPLIED TO THOSE THAT ATTEND
- Firm-Level Compliance Checklist (for the entire firm, particularly management).
- Supervisor Checklist (for those involved in the supervision of “non-authorised” fee earners.
- “Unauthorised Staff Checklist” (I don’t like the title “unauthorised” – but as the webinar makes clear this is a very different thing to “unqualified”.)
- Red Flag Checklist (how you can tell things may be going wrong).
- File Audit Checklist (for each file).
